Sweepstakes Summary Description

AT&T's Share and Win Sweepstakes is offered in and open only to AT&T business customers located in AR, CA, CT, KS, IL, IN, MI, MO, NV, OH, OK, TX, WI, FL, GA, NC, SC, TN, AL, KY, LA, or MS (collectively, fEligible Business Customers"). The sweepstakes runs from 02/01/08 – 12/31/08. One winner per month will be determined by a random drawing by an independent third party. An AT&T Blackberry Curve 8300 will be awarded each month to the winner of the drawing. There is a limit of one (1) prize per business customer. Eligible Business Customers may enter in one of two ways: (1) By visiting http://smallbiz.att.com/u2s/shareandwin and submitting an online form; or (2) by mailing a letter addressed to: AT&T's Share and Win Sweepstakes Entry, 2600 Camino Ramon, Rm: 4S250L, San Ramon, CA 94583 (the letter must specify the Eligible Business name, Customer name, address, and billing telephone number, email address (if any), account number (each letter will constitute an entry for the month in which it is postmarked). There is a limit of one entry per month, per business address, regardless of the method of entry. Participants may enter sweepstakes each month, as each drawing is independent. Drawings will take place within the month following entry. Winners will be notified by email or phone. The prize will be shipped to winner at the business address supplied. Please allow 3-4 weeks from date of notification for receipt of prize. Winners are responsible for all AT&T Blackberry Curve 8300 activation charges, set up fees, monthly charges, any other charges that may apply, payment of taxes on prizes, and for any expenses not specified relating to the use of prizes. NO PURCHASE NECESSARY. A purchase of an AT&T product or service will not increase your chance of winning. Sweepstakes is void where prohibited. Regardless of method submitted, each entry has an equal chance to win.
SWEEPSTAKES PERIOD: Sweepstakes begins 02/01/08 and ends 12/31/08(days are determined by Central Standard Time).PRIZES/APPROXIMATE RETAIL VALUES (ARV): One (1) prize per month: An AT&T Blackberry Curve 8300. Approximate retail value: $349.99.
PRIZE RESTRICTIONS: Winners are responsible for payment of all activation charges, set up, monthly service plan, and any other charges that may apply, taxes on prizes and for any costs not specified relating to the acceptance and use of a prize. No prize transfer. No cash or other prize substitution except by Sponsor who reserves right to substitute a prize of comparable or greater value in the event listed prize is unavailable
CONDITIONS OF PARTICIPATION: By participating, each entrant agrees: (a) to these Official Rules and the decisions of AT&T relating to this Sweepstakes, which decisions shall be final in all respects; (b) to release, indemnify and hold harmless AT&T, its affiliates, and their respective directors, officers, employees, and representatives from any claim, damages or liability resulting from entrants' participation in the Sweepstakes or the acceptance and use of a prize; and (c) if it is a winner, AT&T and affiliates of AT&T may use its and its employees' name and likeness in connection with this sweepstakes without additional compensation or prior review or approval. AT&T is not responsible for the condition or prizes and makes no representation or warranty concerning the prize, including warranty of merchantability or fitness for a particular purpose.
AT&T Operations, Inc. reserve the right, at their sole discretion, to disqualify any individual found, in their sole discretion, to be (a) tampering with the entry process or the operation of the Sweepstakes or web site; (b) in violation of the Terms of Service of the web site; or (c) to be acting in violation of the Official Rules or in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, macro, programmed, third party, or like entry methods will void all such entries, and any participant using any such method will be disqualified. In the event of a dispute as to entries submitted by multiple users having the same email account, the authorized subscriber of the email account used to enter the Sweepstakes at the actual time of registration, will be deemed to be the participant and must comply with these rules. Authorized account subscriber is deemed to be the natural person who is assigned an email address by an Internet access provider, on-line service provider or other organization which is responsible for assigning email addresses or the domain associated with the submitted email address. Sponsor may prosecute any fraudulent activities to the full extent of the law.

GENERAL: AT&T is not responsible for and shall not be liable for: (a) electronic, hardware or software program, network, Internet or computer malfunctions, failures or difficulties of any kind or human error relating to any aspect of the Sweepstakes; (b) failed, incomplete, garbled, lost or delayed email or computer transmissions; (c) lost, late, misdirected, incomplete or illegible entries or mail or postage due mail; and/or (d) any condition, whatever the cause, that may cause the Sweepstakes to be disrupted or corrupted. Sponsor reserves the right, at its sole discretion, to terminate or suspend the Sweepstakes or any portion there of should viruses, bugs, technical difficulties, suspected or actual electronic tampering or other causes corrupt or interfere with the administration, integrity, security or proper play of the Sweepstakes. In such event, notice of any termination or suspension will be posted on this official rules page and prizes will be randomly awarded from among eligible entries received prior to the events giving rise to such termination. ARBITRATION/CHOICE OF LAW: Each entrant agrees that: (a) any and all disputes, claims, and causes of action arising from or related to this Sweepstakes or any prize awarded shall be resolved exclusively by arbitration pursuant to the Rules of the American Arbitration Association; (b) in no event shall it be entitled to incidental and consequential damages. This sweepstakes shall be governed by, and construed in accordance with, the laws of the State of Texas, without regard to conflicts of law principles; and (c) all proceedings shall take place in San Antonio, TX.
